Defiinitions: deliverer (Endreas Rakow - FODB-Database), customer (you)
- Senior IT-Support for the FODB only T&M
- For PC/Laptop fixing: at least 1h has to be billed
- Every 500€ - Donator gets 10h free support, once. Every additional/normal support 40€/h (for minor workload) / 80€/h for complex doings and high workload
- First hour always count full - after that support hours are counted in 15 min steps.
- Hardware over 100€ that has to be ordered has to be paid in advance
- poor people/customer discount (decided individually): 25€/h
- Invoice amounts has to be transerfed by the customer within 2 weeks after getting the invoice, except when payed in cash
- If you want to transfer in Dollar please add the exchange fees. Euro prices in Dollar has to be calculated with current exchange courses
- Support times via Phone: Mo-Fr from 15-21h(3-9 p.m), Saturday between 13-17h(1-5 p.m.) 039037918808 or 01623732606 (0=(+49))
- Invoices always were send via Email, except explicit requestested in the order/project, alternatively via post. In that case the usual post sending fees add to the invoice amount.
- Order changes / extensions:
It is allowed to change requested projects, but only in text-form (email, post, signal message (No WhatsApp)), as long as the realm of the project is not left, and the additional workload is acceptable for the deliverer. If this is the case new deliver dates / project deadlines has to be discussed / changed as well.
Every order change has to be accepted from both sides.
- If order,- or project changes result in significant additional effort a new offer from the deliverer will be provided within 2 weeks that both sides has to agree on.a If the new offer is not accepted within 2 Weeks the project will be finished with old order/project parameters
- This new delivery date has to be communcated either direct or in a separate meeting-protocol and/or other text form. If no meeting or communication is scheduled within the next 4 days the deliverer can communicate a date himself.
- As email communication / email-form is the main communication channel agreements made via email are valid and automatically part of the contract.
- GDPR: No personal information except the email-address used for contract relevant communication is stored. Exception: the actual pay-process, there the official stripe GTCs are relevant.
If not needed for official departments anymore, a user can request the deletion of all personal data in the stored email traffic. - emails are deleted after 5 Years except business relevant informations are included that are really needed. In that case every 5 Years a new consideration regarding degree of importance of the information is done
- Personal data are not stored or are shared with 3rd parties, except explicit discussed and necessary for a project/order.
- If orders are canceled the so far created costs, if any, i.e. hardware, software or the like (i.e. IT-Consulting, and POC), these are invoiced with 30% cancelation fees depending on the height of so far created costs.
- Projects/Orders as references: ( bigger projects & orders from companies) can be published as a working reference (summary of what has been done for which customer), but of course with keeping in mind the personal interests and data protection needs of the customer. If this is not wanted the customer has to place this information direct in the order. Good visible, ideally in bold text. - force majeure clause: If an order / a project cannot be done due force majeure / or an act of nature the deliverer can cancel the contract. So far created costs for the deliverer can be invoiced. So far made project progress is handed over in this case direct as far as the force majeure allows it (data loss or the like) - ESCAPE CLAUSE. In the event that one or more provisions of these terms and conditions of sale and delivery shall be or become unenforceable this shall have no effect on the validity of the remaining provisions and on the contract as a whole. - every customer accept the license model (see main website further down).
